Nebraska Supreme Court Rules in Hall County Case

A decision in Hall County District Court was reversed in the Nebraska Supreme Court. Jillyn Woodward, individually and as Special Administrator of the Estate of Brian K. Woodward had sued CHI Health St. Francis and two doctors for injuries Brian Woodward sustained while receiving care at St. Francis Medical Center in Grand Island. 

The Supreme Court said Woodward offered depositions from three experts – an ER doctor, a rehabilitation doctor specializing in brain injuries, and an anesthesiologist. The defendants subsequently filed a motion to strike the affidavits and the district court later granted the motion.. The Supreme Court ruled the district court erred in striking these affidavits and remanded the case back to the district court for further proceedings.
